12 <br />The City Attorney reviewed the status of title/property ownership related to the final plat <br />and notes mortgage consent will be required if there is a mortgage against the property. <br /> <br />Agreements <br /> <br />Stormwater Maintenance Agreement <br /> <br />The stormwater facilities will be privately maintained and a Declaration for Maintenance <br />of Stormwater Facilities will be required. <br /> <br />Development Agreement and Final Plat <br /> <br />The applicant shall has submitted a Land Use Application for final plat after preliminary <br />plat approval. A Development Agreement will then be prepared by the City as part of the <br />final plat application. <br /> <br />Site Improvement Performance Agreement <br /> <br />A Site Improvement Performance Agreement may be required for construction of the Lil’ <br />Explorer’s Childcare Center facility or securities may be included in the Development <br />Agreement. <br /> <br />Shared Driveway and Parking Access Agreement <br /> <br />A Shared Driveway and Parking Access Agreement and exhibit shall be recorded after <br />final plat approval detailing private maintenance responsibilities include the driveways, <br />landscaped parking lot medians, island landscaping, lighting, and other related <br />appurtenances. <br /> <br />Comprehensive Plan <br /> <br />The preliminary and final plat are consistent with the Comprehensive Plan is regards to <br />resource management system, land use plan, housing plan, transportation plan and <br />sanitary sewer and water supply plan. <br /> <br />Findings of Fact-Final Plat <br /> <br />The Planning and Zoning Board shall consider the final plat and the Community <br />Development Department shall forward the Planning and Zoning Board <br />recommendations to the City Council. The following requirements shall be met before <br />consideration of the final plat by the Planning and Zoning Board: <br /> <br />1. The final plat shall substantially conform to the approved preliminary plat and <br />phasing plan. <br /> <br />The final plat substantially conforms with the revised preliminary plat.
