CITY COUNCIL <br />AGENDA ITEM 3B <br />STAFF ORIGINATOR: Jolleen Chaika, City Clerk <br />MEETING DATE: August 14, 2023 <br />TOPIC: Amending Chapter 617 to Update Licensing Eligibility <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />City Council is being asked to consider the first reading of Ordinance 07-23, <br />BACKGROUND <br />In November 2022, City Council passed Ordinance 03-22, Regulating Edible Cannabinoid <br />Products following the 2022 Minnesota Legislative Session in which Minn. Stat. §151.72 was <br />modified to allow for the sale of certain lower-potency cannabinoid products. In the 2023 <br />Minnesota Legislative Session, §151.72 was further modified to remove restrictions placed on <br />exclusive liquor stores; sale of lower-potency cannabinoid products is now allowed at all exclusive <br />liquor stores. <br />As such, staff is recommending an amendment to 617.05 to remove the prohibition of the sale of <br />edible cannabinoid products (which includes beverages) at exclusive liquor stores in the City of <br />Lino Lakes. One licensed location has recently contacted the Clerkâs Office to request adding a <br />cannabinoid license to allow for sales of these products; however, the current ordinance prohibits <br />the issuance of a cannabinoid license to that liquor license holder at this time. <br />RECOMMENDATION <br />Staff recommends approval of the first reading of Ordinance 07-23 to amend 617.05 to provide <br />consistence with state statute. <br />ATTACHMENTS <br />Ordinance No. 07-23
