CITY COUNCIL <br />AGENDA ITEM 4B <br />STAFF ORIGINATOR: John Swenson, Public Safety Director <br />MEETING DATE: August 14, 2023 <br />TOPIC: Consider 2nd Reading of Ordinance # 04-23 Repealing Ordinance <br />01-22 Creating Chapter 512 Entitled Possession of Catalytic <br />Converters <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />The Minnesota legislature amended MN 325E.21 to address catalytic converter theft through the <br />State of Minnesota. <br />BACKGROUND <br />Council adopted City of Lino Lakes Ordinance #01-22 on May 23, 2022 with the effective date of <br />June 30, 2022. Ordinance #01-22 amended the City Code by adding a new chapter 512 entitled <br />Possession of Catalytic Converters. This ordinance was requested by staff to provide ordinance <br />language that enabled police officers to address the issue of catalytic converter theft. <br />During the State of Minnesota legislative 2023 legislative session MN 325E.21 was amended and <br />signed into law with an effective date of August 1, 2023. <br />Staff and the City Prosecuting attorney have reviewed the amendments to MN 325.21 and <br />determined that City Code Chapter 512, which was enacted under City Ordinance #01-22, is no <br />longer needed. The amendments to MN 325E.21 will make it illegal to possession a used catalytic <br />converter that is not attached to a motor vehicle except in clearly defined exceptions outlined in <br />MN 325E.21. <br />Council approved the 1st Reading of Ordinance #04-23 on July 24, 2023. If approved by Council, <br />Ordinance #04-23 will be published for 30 days with effective date of September 15, 2023. <br />RECOMMENDATION <br />Staff recommends approving the 2nd reading of ordinance 04-23 repealing Ordinance 01-22 <br />Creating Chapter 512 Entitled Possession of Catalytic Converters. <br />ATTACHMENTS <br />City of Lino Lakes Ordinance 04-23 <br />City of Lino Lakes Ordinance 01-22
