CITY COUNCIL <br />AGENDA ITEM 3A <br />STAFF ORIGINATOR: Jolleen Chaika, City Clerk <br />MEETING DATE: August 28, 2023 <br />TOPIC: Amending Chapter 617 to Update Licensing Eligibility <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />In November 2022, City Council passed Ordinance 03-22, Regulating Edible Cannabinoid <br />Products following changes to the state laws to allow for the sale of certain lower-potency <br />cannabinoid products. In the 2023 Minnesota Legislative Session, further amendments were made <br />to existing law to allow for recreational use of cannabis. One such amendment removed restrictions <br />placed on exclusive liquor stores to sell lower-potency cannabinoid products. Currently Chapter <br />617 of Lino Lakes Ordinance prohibits any liquor license holder from selling any lower-potency <br />cannabinoid products. <br />As such, staff is recommending an amendment to Ordinance 617.05 to remove the prohibition of <br />the sale of edible cannabinoid products (which includes beverages) at exclusive liquor stores in <br />the City of Lino Lakes to create consistence with the newly amended state statute. <br />If approved, this ordinance will be published on September 5, 2023 and will be effective on <br />October 5, 2023, at which time liquor stores owners can begin the application process for <br />cannabinoid licenses. <br />RECOMMENDATION <br />Staff recommends approval of the second reading of Ordinance 07-23 to amend 617.05. <br />ATTACHMENTS <br />Ordinance No. 07-23
