<br />CITY OF LINO LAKES <br />ORDINANCE NO. 06 -23 <br /> <br />AN ORDINANCE ENACTING CHAPTER 502 OF THE CITY OF LINO LAKES CODE <br />OF ORDINANCES PROHIBITING CANNABIS USE IN PUBLIC PLACES <br /> <br />The City Council of Lino Lakes ordains: <br /> <br />SECTION 1 ENACTMENT. Lino Lakes City Code Chapter 502 is hereby enacted to <br />read as follows: <br />502.01 Definitions. <br />For the purposes of this chapter, the following definitions apply unless the context clearly <br />indicates or requires a different meaning. <br /> <br />CANNABIS FLOWER, CANNABIS PRODUCTS, LOWER-POTENCY HEMP <br />EDIBLES, AND HEMP-DERIVED CONSUMER PRODUCTS. The definitions as enacted <br />in Minn. Stat. §342.01 <br />ELECTRONIC DELIVERY DEVICE. Any device manufactured, marketed, or sold as e- <br />cigarettes, e-cigars, e-pipes, vape pens, mods, tank systems, or any other product name or <br />descriptor used for the purposes of delivering a substance intended for human consumption <br />through inhalation of aerosol or vapor. <br />PUBLIC PLACE. Property that is generally open to or accessible by the public, except on <br />those premises licensed by the State of Minnesota to permit on-site consumption. <br />PUBLIC PROPERTY. Property, real and personal, that is owned, managed, or controlled by <br />the City, including but not limited to: City buildings and all the land thereon, parking lots, <br />pathways and trails, and city rights-of-way consisting of both the traveled portion and the <br />abutting boulevard, sidewalks and trails, and any City personal property, such as motor vehicles, <br />city equipment, and the like. <br />Sec. 502.02 Prohibited Activity. <br />No person shall consume or smoke cannabis flower, cannabis products, lower-potency hemp <br />edibles, or hemp-derived products in a public place or on public property. <br />Sec. 502.03 Penalty. <br />Violation of this section shall be a petty misdemeanor. <br />SECTION 2. EFFECTIVE DATE.
