2 <br />2.The restriction on working hours in this § 901.03(4)(b)1. does not <br />apply to persons working on their own existing private residences; <br />Currently the only exemption is for persons working on their own private residence. Certain <br />projects, such as a repair of a water main break or storm damage repairs, completed during <br />prohibited hours would be in violation of City Code requirements. Additionally, certain <br />construction practices, such as dewatering, require continuous operation to complete the task. <br />To address these issues staff is proposing an amendment to Section 901.03 to provide certain <br />exemptions from the work hour and day prohibitions. Under the proposed amendment an <br />emergency repair such as a water main break would be exempt from the requirement and <br />undertaken as needed. Other work may be allowed by the City Engineer or Public Services <br />Director, on a case by case basis, if determined necessary to restore public service such as a <br />downed power line or eliminate a hazard, such as a downed tree blocking a road. <br />The amendment also allows for the City Engineer to approve activities such as dewatering, <br />common on both public and private projects. Any approval would be subject to conditions <br />requiring noise mitigation. <br />The City Council approved the 1st Reading on August 28, 2023 with the modification to include <br />“written” approval from the City Engineer under subpart 2.iii. <br />RECOMMENDATION <br />Staff is recommending approval of Ordinance No. 08-23. <br />ATTACHMENTS <br />1.Ordinance No. 08-23.
