2 <br />providers non-exclusive easement(s) for utilities, including, without limitation, fiber optic <br />cabling and electrical power as may be reasonably necessary for utilization of Tenant’s <br />Equipment. In addition, Owner grants Tenant the right to run the necessary cables, conduits, and <br />wires to the Equipment at locations agreed to by Owner and Tenant. Tenant will have the right to <br />add, remove, modify and replace the Equipment from time to time with similar and comparable <br />equipment provided the Equipment does not materially increase the Leased Property, increase <br />loading on the Water Tower or interfere with other equipment on the Water Tower. Prior to <br />Tenant being able to use any new or replacement Equipment on the Leased Property, on a case <br />by case basis as determined by Owner, Tenant may have to conduct and provide to Owner an <br />passing structural analysis demonstrating that the Water Tower has sufficie nt structural capacity <br />for Tenant’s Equipment. In addition, if there is a reasonable basis to believe that Tenant’s <br />Equipment will interfere with the equipment of any other user of the Water Tower, then Owner <br />may further require that Tenant conduct and provide to Owner an interference study indicating <br />that the placement of the Equipment on the Leased Property presents no significant risk of <br />interference with any other user of the Water Tower having a higher priority or equal priority. <br />Owner has the authority, at the cost to the Tenant, to hire a qualified engineering firm to review <br />proposed installations, review structural analyses, RF interference studies, as well as perform <br />inspections of above mention items as directed; provided, however, that Owner shall obtain an <br />estimate of such costs and Tenant’s prior written approval shall be required if the estimate <br />exceeds the then current escrow balance by more than $2,000 or if the estimate exceeds the <br />Original Escrow Balance (as hereinafter defined). Subject to the foregoing, such costs will be <br />reimbursed to Owner. <br />3.The Equipment. Tenant’s initial installation on the Water Tower shall include the <br />following: <br />(i) 3 antennas, 6 RRUs, and 1 OVP. <br />(ii) Transmission lines, mounting and grounding hardware, which lines and <br />equipment must be anchored and installed on the Water Tower in accordance with <br />good and accepted engineering practices, and which must not interfere with <br />Owner's use of the Water Tower.
