B. Consider 2nd Reading Ordinance No. 09-23, Approving Sale of Land to JAVA <br /> Companies, LLC, Lots 12 & 13, Block 2, Carole Estates 2nd Addition and Part of 7685 <br /> Lake Drive <br /> City Administrator Sarah Cotton presented the second reading of Ordinance 09-23 for <br /> Council consideration. She advised that the Ordinance, if approved, allows for the sale <br /> of City property to JAVA Companies as explained when the first reading was presented <br /> to Council on August 28, 2023. <br /> i. Motion to: Dispense of full reading of Ordinance 09-23 <br /> .. ...... .... ....... ..... .... . ...... .. <br /> RESULT: CARRIED[UNANIMOUS] <br /> MOVER: Lyden <br /> SECONDER: Cavegn <br /> AYES: Lyden, Cavegn,Stoesz, Ruhland, Rafferty <br /> ii. Motion to: Approve Second Reading of Ordinance 09-23 <br /> RESULT: CARRIED[4-0] <br /> MOVER: Cavegn <br /> SECONDER: Stoesz <br /> AYES(Roll Call): Lyden, Stoesz, Cavegn, Rafferty <br /> ABSTAIN: Ruhland <br /> C. Consider Resolution No. 23-91, Approving Change Order No. 2, 2023 Pheasant Run <br /> Reconstruction Project <br /> City Engineer Diane Hankee requested approval of Change Order Number 2 for the <br /> Pheasant Run reconstruction project. She advised the change order relates to removal <br /> and replacement of gate valves; the total of the change order is $58,440.00. She advised <br /> that the amount of the change order is within the projected contingencies and is within <br /> budget. <br /> i. Motion to: Approve Resolution 23-91 <br /> RESULT: CARRIED[UNANIMOUS] <br /> MOVER: Lyden <br /> SECONDER: Stoesz <br /> AYES: Lyden, Stoesz, Ruhland, Cavegn, Rafferty <br /> 7.
