<br /> <br />JOINT POWERS AGREEMENT <br />FOR IMPROVEMENTS AT THE INTERSECTION OF <br />COUNTY STATE AID HIGHWAY 14 AND CR 53 <br />IN THE CITY OF LINO LAKES, MN <br />(S.P. 002-614-049) <br />(S.A.P 210-020-013) <br /> <br /> THIS AGREEMENT is made by the parties on the last date executed below, by and between the <br />County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, <br />Minnesota 55303, hereinafter referred to as "County", and the City of Lino Lakes, 600 Town Center <br />Parkway, Lino Lakes, MN 55014, hereinafter referred to as "City". <br /> <br />WITNESSETH <br /> <br /> WHEREAS, the parties to this agreement agree it is in the best interest of the traveling public to <br />reconstruct the intersection of County State Aid Highway (CSAH) 14 (Main Street/125th Avenue NE) at <br />County Road (CR) 53 (Sunset Avenue) and, <br /> <br /> WHEREAS, said parties mutually agree that County State Aid Highway 14 and County Road 53 <br />is in need of reconstruction; and, <br /> <br /> WHEREAS, the County has prepared preliminary design plans for the reconstruction of County <br />State Aid Highway 14 and County Road 53 in accordance with Anoka County and the Minnesota <br />Department of Transportation standards to a staff approved layout condition; and, <br /> <br /> WHEREAS, Anoka County has jurisdiction over the intersection of County State Aid Highway <br />14 and County Road 53 and, <br /> <br /> WHEREAS, the parties agree that it is in their best interest that the cost of said project be shared; <br />and, <br /> <br /> WHEREAS, Minn. Stat. § 471.59 authorizes government entities and political subdivisions of <br />the state to enter into joint powers agreements for the joint exercise of powers common to each. <br /> <br /> NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br /> <br />I. PURPOSE <br /> <br />The parties have joined together for the purpose of reconstructing the roadway, drainage, trail, as well as <br />other utilities on CSAH 14 and CR 53; as described in the preliminary design plans (hereinafter <br />collectively the “Project”). The County Project numbers for the reconstruction are stated in the caption <br />above. Said engineering plans are filed in the office of the Anoka County Highway Department and <br />incorporated herein by reference. <br /> <br />The parties to this Joint Powers Agreement (JPA) agree in principle that the Project is in the best interest <br />of the traveling public and that the Preliminary Layout as shown in Exhibit A defines the preliminary <br />design of the Project. All exhibits referenced or attached to this JPA are incorporated and made part of <br />this Agreement. <br />175
