Other Miscellaneous ESST Details <br />An employer cannot require that an employee seek or find a replacement <br />worker to cover hours used as ESST. <br />ESST must be paid at the employee’s hourly rate of pay, but no lower than <br />minimum wage. <br />An employer cannot retaliate or discriminate against an employee for exercising <br />their ESST rights. <br />Group insurance coverage must be maintained while an employee is using <br />ESST. <br />An employee returning from leave who was using ESST is entitled <br />reinstatement and pre-leave benefit reinstatement and seniority as if there was <br />no interruption in service.
