1 <br />CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 3C <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br />MEETING DATE: January 22, 2024 <br />TOPIC: Vacating Drainage & Utility Easement, 6049 Sargent Court North <br />i.Consider 2nd Reading of Ordinance No. 01-24, Vacating <br />Drainage & Utility Easement Lot 7, Block 1, Otter Bay <br />*Council may vote to dispense with the full reading of the ordinance <br />*Roll call vote is required for adoption of the ordinance <br />ii.Consider Resolution No. 24-08, Approving Summary <br />Publication of Ordinance No. 01-24 <br />VOTE REQUIRED: 4/5 <br />_____________________________________________________________________________ <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 2nd Reading of Ordinance No. 01-24, <br />vacating Drainage and Utility easement, Lot 7, Block 1, Otter Bay. <br />BACKGROUND <br />6049 Sargent Court North is a residential parcel owned by, Rebecca and Brian Teeters <br />(Rebecca Morlando). The property owner submitted a land use application requesting the <br />vacation, of a portion, of a drainage easement on their property. <br />The drainage and utility easement was dedicated to the City of Lino Lakes with the 1987 Otter <br />Bay plat. The easement is intended to perpetuate drainage across the parcel. The current <br />owners would like to vacate a portion of the easement area where there is an existing <br />concrete patio. The City doesn’t allow for patios and structures in drainage and utility <br />easements and the current property owners would like to vacate the easement so their <br />property is in compliance. <br />The Drainage and Utility Easement Vacation Description Sketch prepared by Sambatck <br />received on October 20, 2023 details the proposed drainage and utility area to be vacated <br />where the existing patio is located. <br />RECOMMENDATION <br />83
