1 <br /> <br />CITY COUNCIL <br />WORK SESSION STAFF REPORT <br />ITEM NO. 3 <br /> <br />STAFF ORIGINATOR: Sarah Cotton, City Administrator <br /> <br />WORK SESSION DATE: February 5, 2024 <br /> <br />TOPIC: City Council Code of Conduct and Meeting Rules of Decorum <br />______________________________________________________________________________ <br />BACKGROUND <br />In 2003, the City Council adopted Ethical Rules and Guidelines for the Council to adhere to; in <br />2006, these guidelines were modified into the Council Code of Conduct. Since that time, there <br />have been various iterations of the Code of Conduct that have been adopted by Council, the most <br />recent in 2018, attached hereto for reference. <br /> <br />Staff has drafted a proposed revision and update to the Code of Conduct for Council’s <br />consideration; a redlined draft is attached for review. This is a working draft and comments, <br />feedback, suggestions, and input from Council are welcomed. <br /> <br />Furthermore, staff is also proposing that Council consider for adoption Rules of Decorum for City <br />Council meetings. While public comment is not required at any public meeting under the <br />Minnesota Open Meeting Law statutes, the City Charter does require that Council consider public <br />comment at any public meeting (see Charter, Section 3.01) but that Council may place reasonable <br />restrictions upon comments and questions. The proposed Rules of Decorum would accomplish <br />the objective laid out in the Charter by providing guidelines for resident participation during <br />meetings and work sessions. Guidance would also be provided for Council to enforce the rules, <br />resulting in more orderly and organized public meetings. <br /> <br />REQUESTED COUNCIL DIRECTION <br />Presented for Council discussion and feedback. The current Code of Conduct requires that <br />following each municipal election, the new Council shall ratify the Code of Conduct by resolution. <br />Staff will bring forward a formal resolution at the February 12, 2024 meeting following direction <br />from Council. <br /> <br />ATTACHMENTS <br />Proposed Updated Code of Conduct (redlined) <br />Proposed Rules of Decorum with Sign-In Sheet <br />2018 Code of Conduct <br /> <br />35
