1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6A <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: January 8, 2018 <br /> <br />TOPIC: PUBLIC HEARING: Consider 1st Reading of Ordinance No. <br />01-18, Vacating Drainage & Utility Easements, Lot 1, Block 1, <br />Pine Glen <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of Ordinance No. 01-18, Vacating Drainage & <br />Utility Easements, Lot 1, Block 1, Pine Glen. <br /> <br />BACKGROUND <br /> <br />The owners, Scott and Shelly Carlson, of All Seasons Rental located at 7932 Lake Drive are <br />proposing to expand their existing business. They have purchased 7928 Lake Drive a vacant <br />1.3 commercial parcel to the south (Lot 1, Block 1, Pine Glen) with the intent to final plat their <br />parcels. <br /> <br />The development is a combination of 3 parcels. The existing north parcel is unplatted and has a <br />metes and bounds legal description. The vacant south parcel is platted and legally described as <br />Lot 1, Block 1, Pine Glen. The third parcel is a remnant parcel along Lake Drive. The parcels <br />will be combined via plat to provide clear title and dedicate required easements. The name of <br />the plat is SS Properties Addition. <br /> <br />ANALYSIS <br /> <br />The SS Properties Addition final platting process requires that existing drainage and utility <br />easements be vacated on Lot 1, Block 1, Pine Glen. The vacation includes the standard <br />property line easement, a drainage and utility easement over an existing stormwater retention <br />pond on the east side. These existing easements will be vacated as detailed in the enclosed <br />drainage and utility easement vacation sketch. <br /> <br />New easements will be included with the SS Properties Addition final plat to cover the entire <br />site and expanded stormwater facilities. The existing retention pond will be expanded and <br />included in a new drainage and utility easement. An Ordinance is required to vacate the <br />easement and the City Council is to hold public hearings for the vacation. <br /> <br /> <br />
