<br />• Removal of rooftop units is scheduled to begin at 10 PM on Tuesday, February <br />13th. The crane is scheduled to be set up on the north side of the building prior to <br />10 PM on February 13th, so they can begin the work right at 10 PM. The <br />lifting/removal of the north side rooftop unit will take approximately 30 minutes. <br />Then, the crane will be disassembled and moved to the south side of the building. <br />The disassembly and moving of the crane is estimated to take two hours, at most. <br />Once set up on the south side, the crane will remove the south side rooftop unit, <br />which will take approximately 30 minutes. Then, the crane will be taken down <br />for the night. <br />• Installation of the new rooftop units is scheduled for Wednesday, February 14th. <br />Same process for installation as the removal above. <br />The City ordinance does not allow for this type construction activity during the <br />articulated timeline. <br /> <br />Staff has researched the ordinance to determine if there are any options to complete this <br />work within the current framework of the ordinance on Ryan Companies desired plan. In <br />the current framework, there is no mechanism to accommodate this construction activity <br />within the ordinance framework. <br /> <br />Some potential solutions to consider are: <br />1. Amend the current City Ordinance to accommodate this type of construction <br />activity. Please note that amending the ordinance could not be accomplished in <br />the timeline, which Ryan Companies is requesting due to statutory requirements <br />related to passage of City ordinances. <br />2. Consider authorizing a Special Event Permit to allow this construction activity to <br />take place on the desired timeline. It should be noted that a Special Event is <br />defined in City ordinance 615.02 as; “An outdoor gathering of at least 50 <br />individuals whether on public or private property, assembled with a common <br />purpose for a period of one hour or longer. Special events include, but are not <br />limited to concerts, fairs, circuses, parades, open air markets, marathons, <br />walkathons, festivals, races, and bicycles events, celebrations or any other <br />gathering or event of similar nature. Special events do not include <br />noncommercial events held on private property such as graduation parties or <br />social parties.” Council has approved Special Event Permits for activity that is <br />based on community gatherings previously, but has not authorized construction <br />activity through a Special Events Permit. <br />3. Take no action and require Ryan Companies to complete the work within the <br />current framework of the City ordinance. <br /> <br />Staff is seeking Council direction on how to proceed. <br /> <br />Attachments <br />City Ordinance 901.03
