Consider Resolution No. 18-30 Approving Fence <br />Agreement <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Great River Energy is granting a Right-of-Way Easement to the City over a portion of their <br />property located west of Holly Drive East. A Fence Agreement is required as it relates to their <br />existing fence in the easement area. <br /> <br />BACKGROUND <br /> <br />In 2017, Great River Energy purchased 3 parcels west of Holly Drive East (PID#34-31-22-21- <br />0001, 34-31-22-24-0002 and 34-31-22-32-0003). A portion of the paved road surface of Holly <br />Drive East extends onto PID# 34-31-22-21-0001 and provides access to 1381 Holly Drive. The <br />Right-of-Way Easement grants the City a perpetual easement for roadway purposes and <br />clarifies any prescriptive rights. The easement is 50 feet by 120 feet and covers the northeast <br />corner of the parcel as shown on Exhibit A of the Easement. <br /> <br />Great River Energy owns and maintains a fence and gate located within the Right-of-Way <br />Easement. The Fence Agreement details responsibilities of each party regarding the fence. <br />Great River Energy is ultimately responsible for maintenance costs of the fence. The City <br />would be responsible for relocation costs if future road improvements to Holly Drive required <br />the fence to be removed or relocated. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends approval of Resolution No. 18-29 and Resolution No. 18-30. <br /> <br />ATTACHMENTS <br /> <br />1.
