1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6A <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: May 29, 2018 <br />TOPIC: Drainage and Utility Easement Vacation <br />i) Consider 2nd Reading of Ordinance Ordinance No. 03-18, <br />Vacating Drainage & Utility Easement, Outlot B, <br />Northpointe 5th Addition <br /> *Council may vote to dispense with the full reading of the ordinance <br /> *Roll call vote is required for adoption of the ordinance <br /> <br />ii) Consider Resolution No. 18-53, Approving Summary <br />Publication of Ordinance No. 03-18 <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of Ordinance No. 03-18, vacating drainage and <br />utility easements lying over, under and across Outlot B as created and dedicated in the plat of <br />Northpointe 5th Addition. <br /> <br />BACKGROUND <br /> <br />Northpointe is a PUD residential subdivision located northeast of the intersection of Birch <br />Street and 20th Avenue South/CSAH 54. The applicant is requesting this drainage and utility <br />easements be vacated to remove underlying easements concurrent to the NorthPointe 7th <br />Addition final plat. Revised easements will be re-dedicated on the final plat of Northpointe 7th <br />Addition. The City Council has approved similar vacations with previous final plats in <br />Northpointe. <br /> <br />The Drainage and Utility Easement Vacation Description Sketch prepared by Carlson McCain <br />on April 4, 2018 detailing the proposed drainage and utility area to be vacated is enclosed. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 2nd Reading of Ordinance No. 03-18 Vacating Drainage <br />& Utility Easements, Outlot B, NorthPointe 5th Addition, and approval of Resolution No. 18- <br />53, Approving Summary Publication of Ordinance No. 03-18. <br /> <br /> <br />
