Watermark <br />Grading and Trunk Utility Agreement <br />June 11, 2018 <br /> page 2 <br />The Developer shall perform the work in accordance with a Storm Water <br />Pollution Prevention Plan (SWPPP) pursuant to Minnesota Pollution Control <br />Agency (MPCA) requirements. <br />c. The Developer shall grade the site to within 0.2 foot of the grades shown on the <br />approved grading plan. No deviations will be allowed unless a revised plan is <br />submitted and approved by the City and all other regulatory agencies. The <br />Developer’s engineer shall certify in writing, with an as-built survey, that all <br />grading complies with the approved grading plan. <br />d. The surface water drainage ways shall be constructed and or graded. <br />e. The Developer shall be responsible for ascertaining that site geotechnical and <br />groundwater conditions are adequate and conforming with the grading and site <br />improvement as proposed. <br />f. The Developer shall maintain a clean site including the removal of sediment that <br />may track offsite within public rights-of-way resulting from construction by the <br />Developer, within five (5) days after notification by the City. <br />6. Time of Performance. The Developer shall install all required improvements <br />enumerated in Paragraph 6 by November 30, 2018. The Developer may request a <br />reasonable extension of time from the City. If the extension is granted, it shall be <br />conditioned upon updating the security posted by the Developer to reflect cost <br />increases and the extended completion date. <br />7. City Improvements. The Developer shall install the following public improvements at <br />its sole cost. In the event these improvements need to be modified due to changes in <br />the approved plans, Developer shall do so at its own expense. Developer expressly <br />acknowledges that installing these utilities prior to receiving full project approvals is <br />done at the Developer’s risk. Credit for installation of trunk utilities, as provided by City <br />policy, shall not be provided to Developer until the final plat for the initial phase of th e <br />Subdivision is approved by the City. <br />a. Storm Water Trunk Line. Developer shall install a 42 to 60 inch diameter <br />Reinforced Concrete Pipe under the berm on the eastern edge of the Subdivision <br />pursuant to the approved Trunk Utility Exhibit prepared by Carlson McCain, <br />dated May 31, 2018. <br />b. Sanitary Sewer Trunk Line. Developer shall install the Sanitary Sewer Trunk line <br />under “Street A” and along 20th Avenue North (CSAH 54) approximately 600 feet <br />north as provided in the Trunk Utility Exhibit prepared by Carlson McCain, dated <br />May 31, 2018. The Developer’s engineer shall certify in writing with an as-built <br />survey that the location and elevation comply with the approved utility plan.
