11 <br />(e) Waste disposal systems. A proposed subdivision shall be served with <br />adequate waste disposal systems when: <br />1. The urban sewered subdivision is located inside the city's MUSA or is <br />consistent with the MUSA allocation criteria; <br />2. The city has sufficient MUSA and pipe capacity to serve the subdivision <br />if developed to its maximum density; <br />3. The subdivision will result in a sewer extension consistent with Lino <br />Lakes sewer plan and capital improvement plan; <br />4. A rural subdivision can demonstrate that each lot can be served by an <br />adequate sanitary sewer disposal system; and <br />5. A rural subdivision with a proposed communal sanitary sewer or water <br />system has an effective long range management and maintenance program <br />with proper financing. <br /> <br />The Drilling Estates preliminary plat is served with an adequate waste disposal <br />system. The existing two (2) single family detached dwellings are connected to <br />the City of Centerville municipal sanitary sewer system. <br /> <br /> Findings of Fact-Final Plat <br /> <br />Per Section 1001.057 Review, Approval or Denial: <br /> <br /> (1) The Planning and Zoning Board shall consider the final plat and the <br />Community Development Department shall forward the Planning and Zoning <br />Board recommendations to the City Council. The following requirements shall be <br />met before consideration of the final plat by the Planning and Zoning Board: <br /> <br />(a) The final plat shall substantially conform to the approved preliminary plat <br />and phasing plan; <br /> <br />The Drillings Estates final plat substantially conforms with the preliminary plat. <br /> <br />(b) For plats that consist solely of individual single family residential lots, final <br />plat applications for subsequent phases shall not be approved until <br />building permits have been issued for 40% of lots in the preceding phase. <br />This division applies only when the preceding phase consists of 40 or <br />more lots; and <br /> <br />The Drilling Estates lot line adjustment between two (2) existing single family <br />detached dwellings will be final platted in one (1) phase. <br /> <br />(c) Conditions attached to approval of the preliminary plat shall be <br />substantially fulfilled or secured by the development agreement, as <br />appropriate. <br />
