1 <br />CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 6C <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br />MEETING DATE: May 13, 2024 <br />TOPIC: PUBLIC HEARING: Consider 1st Reading of Ordinance No. 06-24, <br />Vacating Drainage & Utility Easement, 202 Elm Street <br />VOTE REQUIRED: 4/5 <br />_____________________________________________________________________________ <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 1st Reading of Ordinance No. 06-24, <br />vacating Drainage and Utility easement, 202 Elm Street. <br />BACKGROUND <br />202 Elm Street a residential parcel owned by, John Grattan III. The property owner submitted <br />a land use application requesting the vacation, of a portion, of a drainage easement on their <br />property. <br />The drainage and utility easement was dedicated to the City of Lino Lakes with the 2021 Bald <br />Eagle Addition plat. The easement is intended to perpetuate drainage across the parcel. The <br />current owner would like to vacate a portion of the easement area where there is an existing <br />concrete pad. He plans to construct a 16X20’ building in this location. The City doesn’t allow <br />for structures larger than 120 sf within drainage and utility easements. The property owner <br />would like to vacate the easement so their property is in compliance. <br />The Drainage and Utility Easement Vacation Description Sketch prepared by EG Rud and Sons, <br />Inc. received on April 18, 2024 details the proposed drainage and utility area to be vacated <br />where the existing concrete slab is located. <br />The second reading of the ordinance is scheduled for May 28, 2024. <br />RECOMMENDATION <br />Staff is recommending approval of the 1st Reading of Ordinance No. 06-24 Vacating Drainage <br />& Utility Easements, 202 Elm Street. <br />ATTACHMENTS <br />95
