WHEREAS, the City completed a minor subdivision and acquired land for the purposes of <br />constructing a Water Treatment Plant, and <br />WHEREAS, the property acquired included land within Anoka County Right -of -Way Plat No. 11, <br />filed for record in September of 1978 as Document No. 508243, and <br />WHEREAS, the property is used for public road purposes as County State Aid Highway 10 (Birch <br />Street), and <br />WHEREAS, it is in the best interest of the City and County to provide an easement over a <br />portion of the property, for public road purposes, legally described as: <br />That part of Anol<a County Highway Right -of -Way Plat No. 11, Anol<a County, <br />Minnesota which lies within the Northeast Quarter of the Southeast Quarter of Section <br />28, Township 31, Range 22, Anoka County Minnesota. <br />MOW, THEREFORE RE IT RES®LVE® by the City Council of Lino Lal<es, Minnesota that the City <br />hereby grants to the County of Anoka a right-of-way easement over, under and across the <br />above referenced property. <br />�E IT FURTHER RES®LVE®, that the City Attorney is authorized to draft the easement, subject <br />to County review, for execution by the Mayor and Clerk. <br />Adopted by the City Council of the City of Lino Lakes this 28th day of May 2024. <br />Ro bR <br />OTTFCT• <br />Hannah Lynch, pity C;lerl< <br />fferty, <br />Mayor <br />
