Consider Resolution No. 24-94, Approving 2nd <br />Amendment to Open Space Easement for Watermark <br /> <br />VOTE REQUIRED: 4/5 <br />_____________________________________________________________________________ <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the 2nd Reading of Ordinance No. 10-24, <br />vacating drainage and utility easement, Outlot C, Watermark 5th Addition, approving a <br />summary publication of the ordinance, and amending the open space easement for <br />Watermark. <br /> <br />BACKGROUND <br /> <br />Outlot C, Watermark 5th Addition has a drainage and utility easement over it which <br />encompasses a wetland, stormwater management, and is part of the City’s greenway system. <br />The outlot is owned by US Home LLC (aka Lennar Corporation). With the platting of <br />Watermark 7th Addition there was small portion of the drainage and utility easement that <br />changed. The Watermark 7th Addition plat will dedicate a new drainage and utility easement <br />over the outlot. This vacation will only be in place upon the platting of Watermark 7th <br />addition. <br /> <br />The Drainage and Utility Easement Vacation Description Sketch prepared by Carlson McCain <br />received on June 10, 2024 details the proposed drainage and utility area to be vacated. <br /> <br />Subsequent to the easement modification the open space easement shall be amended also. <br /> <br /> <br />
