be described; thence northeasterly to the southeast corner of Lot 4, Block 5, said <br />SHORES OF MARSHAN LAKE, and there terminating. <br />The side lines of said strip of land shall be lengthened or shortened to terminate on the <br />north line of Lot 8, Block 5, said SHORES OF MARSHAN LAKE and on the easterly line of the <br />trail easement in said Lot 13, as dedicated in said SHORES OF MARSHAN LAKE. <br />Attachment B —Trail Easement Vacation Exhibit (Lots 1-4,, 13 and 14,, Block 5, Shores of <br />Marshan Lake) <br />Description of Trail Easement area to be vacated: <br />All remaining trail easements in Lots 1, 2, 3, 4, 13 and 14, Block 5, SHORES OF MARSHAN LAKE, <br />according to the recorded plat thereof, Anoka County, Minnesota, as dedicated by said plat, <br />which were not previously vacated by Document No. 1182624, are now to be vacated. <br />3. A public hearing was held on May 28, 2024 before the City Council in the City Hall <br />Council Chambers after due published and posted notice had been given and reasonable <br />attempts were made to give personal notice to all affected property owners, and all <br />persons interested were given an opportunity to be heard; and <br />4. The Shores of Marshan Lake was platted in 1992. The boardwalk and trail within the plat <br />have been removed and the Easement is no longer needed; and <br />5. Resolution No. 95-89 (Document #1182624) previously vacated portions of the <br />Easement dedicated on the plat over Lots 4 -13, Block 5, Shores of Marshan Lake; and <br />6. It appears to be in the best interest of the City to vacate such Easement; and <br />7. This ordinance shall be recorded with Anoka County; and <br />8. Four -fifths of all members of the City Council concur with this ordinance. <br />Section 2: Easement Vacated <br />The Easement described herein is hereby vacated. <br />Section 3: Effect <br />This ordinance shall be in force and effect from and after its passage and publication according <br />to the Lino Lakes City Charter and upon filing of the Easement Vacation Ordinance. <br />Adopted by the Lino Lakes City Council this loth day of June, 2024. <br />4 <br />
