CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 3A <br />STAFF ORIGINATOR: Sarah Cotton, City Administrator <br />MEETING DATE: August 12, 2024 <br />TOPIC: Legal Validity of Initiative and Charter Amendment Petitions <br />VOTE REQUIRED: Simple Majority <br />INTRODUCTION <br />The Council is being asked to consider Resolution No. 24-107 relating to the legal validity of <br />three petitions received. <br />BACKGROUND <br />On Monday, July 1, three petitions were received by the City in the Office of the City Clerk. Two <br />of the petitions received propose charter amendments and the third proposes the adoption of <br />an ordinance. <br />As required by State Law and the City Charter, the City Clerk examined the three petitions for <br />technical sufficiency in terms of form and the required number of signatures and reported to <br />the Council on Monday, July 8. Upon receiving the report, the Council adopted Resolution Nos. <br />24-95, No. 24-96, and No. 24-97 certifying the technical sufficiency of the three petitions <br />received. <br />At the July 8 City Council meeting, City Attorney Jay Squires briefed the Council, noting that he <br />would be reviewing the petitions for legal validity and would report to the Council at a future <br />meeting date. <br />At the July 22 City Council meeting, City Attorney Jay Squires reviewed his legal opinion related <br />to the petitions and received Council direction regarding the preparation of Resolution No. 24- <br />107. <br />RECOMMENDATION <br />Staff is recommending the approval of Resolution No. 24-107, A Resolution Related to the Legal <br />Validity of Initiative and Charter Amendment Petitions. <br />ATTACHMENTS <br />Resolution No. 24-107, A Resolution Related to the Legal Validity of Initiative and Charter <br />Amendment Petitions <br />
