2 <br />ANALYSIS <br /> <br />City Code Section 1007.056 regulates home occupation permits. <br /> <br />Per City Code Section 1007.056(6)(a) <br /> <br />14. No motor vehicle repair, paint or body work; commercial preparation of food for <br />service on the premise; business related to or involving explosives, ammunition or <br />weapons; or ambulance or related emergency services shall be permitted as a home <br />occupation. <br /> <br />The applicant is requesting the ordinance be amended to: <br /> <br />14. Currently, his <br />business is licensed with ATF and has a Federal Firearms License (FFL) type 7. <br /> <br />Previous Zoning Ordinance <br /> <br />In 2010, the City Council adopted Ordinance No. 01-10 which amended the zoning <br />ordinance related to home occupation. That ordinance included the language <br />prohibiting any business involving explosives, ammunition or weapons as a home <br />occupation. Staff reviewed previous staff reports and minutes and did not find any <br />particular reason why this language was added. <br /> <br />ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives) <br /> <br />The ATF is the federal agency that regulates explosives, ammunition and weapons. Per <br />their website What We Do | Bureau of Alcohol, Tobacco, Firearms and Explosives <br />(atf.gov) and attached, ATF's responsibilities include the investigation and prevention of <br />federal offenses involving the unlawful use, manufacture, and possession of firearms <br />and explosives; acts of arson and bombings; and illegal trafficking of alcohol and tobacco <br />products. The ATF also regulates, via licensing, the sale, possession, and transportation <br />of firearms, ammunition, and explosives in interstate commerce. <br /> <br />Public Safety <br /> <br />Lino Lakes Public Safety reviewed the proposed text amendment and have no objection. <br /> <br />Other Communities
