12 <br /> <br />The four (4) lots south of 77th Street shall be rezoned from NB, Neighborhood Business <br />to GB, General Business to allow for Building B (drive-throughs are not allowed in NB <br />zoning district) and Building C (automotive repair-minor is not allowed in NB zoning <br />district). <br /> <br />History <br /> <br />In 1999, the lots on the west side of Lake Drive in this corridor were zoned NB, <br />Neighborhood Business. The 4 lots north of 77th Street were rezoned to GB, General <br />Business when the City sold the old police station to the American Legion because liquor <br />sales were not allowed in NB. In 2022 when the City did a major update to the zoning <br />ordinance and map, the lots north of the American Legion were zoned PSP, Public Semi- <br />Public (City fire station) and GB, General Business to be consistent with the 2040 <br />Comprehensive Plan commercial land use and existing conditions. The lots south of 77th <br />Street remained NB, Neighborhood Business until time of redevelopment. <br /> <br />Per City Code Section 1007.015 (4): <br /> <br /> (e) The Planning and Zoning Board shall hold the public hearing and consider possible <br />adverse effects of the proposed amendment. Its judgement shall be based upon, but not <br />limited to, the following factors: <br /> <br />1. The proposed action is consistent with the official City Comprehensive Plan. <br /> <br />The rezoning is consistent with the 2040 Comprehensive Plan. The land is guided <br />commercial. GB, General Business is a business/commercial zoning district. <br /> <br />2. The proposed action is or will be compatible with present and future land uses <br />of the area. <br /> <br />The rezoning is compatible with the adjacent GB, General Business zoned parcels along <br />Lake Drive. <br /> <br />3. The proposed action conforms with all performance standards contained herein. <br /> <br />The proposed commercial development conforms with all performance standards with <br />minor revisions as noted. <br /> <br />4. The proposed action can be accommodated with existing public services and will <br />not overburden the city’s service capacity. <br /> <br />The proposed commercial development can be accommodated with existing public <br />services and will not overburden the city’s service capacity.
