CITY OF LINO LAKES <br />RESOLUTION NO. 24-142 <br />RESOLUTION APPROVING LINO RETAIL 2.0 PRELIMINARY PLAT <br />WHEREAS, the City received a land use application for Lino Retail 2.0 preliminary plat <br />("Development"); and <br />WHEREAS, City staff completed review of the Development based on the following <br />submittals: <br />• Preliminary Plat prepared by Design Tree dated September 9, 2024 <br />• Civil Plan Set prepared by Design Tree dated September 4, 2024 <br />• Landscape Plan prepared by Plan -Type dated August 2, 2024 <br />• Architectural Plans prepared by Lampert Architects dated September 6, 2024 <br />• Final Stormwater Management Study prepared by Design Tree dated July 16, 2024 <br />• Geotech Sketch and Logs prepared by Braun Intertec dated August 27, 2024 <br />• Traffic Impact Study prepared by Alliant dated September 23, 2024; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on October 9, <br />2024 and the Board recommended approval of the preliminary plat with a 5-0 vote. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: <br />FINDINGS OF FACT <br />Per City Code Section 1001.013, Premature Subdivision: <br />(1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to <br />the following criteria shall be denied by the City Council. <br />(2) Conditions for establishing a premature subdivision. A subdivision maybe deemed <br />premature should any of the following conditions not be met. <br />(a) Consistency with the Comprehensive Plan. Including any of the following: <br />1. Land use plan; <br />2. Transportation plan; <br />3. Utility (sewer and water) plans; <br />4. Local water management plan; <br />5. Capital improvement plan; and <br />6. Growth management policies, including MUSA allocation criteria. <br />Lino Retail 2.0 preliminary plat is consistent with the goals and policies of the comprehensive <br />plan. <br />
