Consider Resolution No. 24-152, Approving Summary <br />Publication of Ordinance No. 15-24 <br />VOTE REQUIRED: 4/5 <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 2nd Reading of Ordinance No. 15-24 <br />Vacating Drainage & Utility Easement, 1057 Black Duck Court, Lot 14, Block 2, Black Duck <br />Estates. <br />BACKGROUND <br />1057 Black Duck Court a residential parcel owned by Patrick & Heather Galvin. The property <br />owner submitted a land use application requesting the vacation, of a portion, of a drainage <br />and utility easement on their property for the installation of a deck and for compliance with <br />City code. <br />The drainage and utility easement was dedicated to the City through the platting process pre <br />wetland conservation act. The property owner has completed an approved wetland <br />delineation on the property. Staff has reviewed the delineation and grading of this site and <br />the adjacent properties to determine the area that could be vacated. The property owner is <br />going to move their shed and complete grading on the site to become in compliance with <br />code. The vacation of the easement will also allow them to construct a deck which was not <br />previously allowed due to the easement. <br />The Drainage and Utility Easement Vacation Description Sketch prepared by E.G Rud and Sons, <br />Inc. received on October 15, 2024 details the proposed drainage and utility area to be <br />vacated. <br />
