2 <br />The following staff report is based on the following: <br /> <br />• Existing and Proposed Site Improvement Plans prepared by Dream Scapes Landscaping <br />& Design, Inc, latest revision date December 2, 2024. <br />• Certificate of Survey prepared by E.G. Rud & Sons, Inc. latest revision November 20, <br />2024. <br /> <br />BACKGROUND <br /> <br />Current Use <br /> <br />The 40 acre site 8196 20th Ave is located just east of 20th Ave and directly west of 35E. The site <br />has a single family detached dwelling, two (2) accessory buildings, pool, and shed. It is <br />currently zoned R-Rural and used for agricultural production of primarily row crops. The <br />applicant is looking to switch uses from annual row crops to maintaining a tree farm. Stockpile <br />operations onsite will aid the proposed tree farm and provide soil required for the proposed <br />operation. <br /> <br />There is already an existing stockpile located onsite which is proposed to be used for future tree <br />farm operations and maintained as the permitted stockpile. <br /> <br />On November 21, 2024 the City approved a site plan review for two accessory buildings, the <br />grading and construction of a new driveway, and stormwater facilities. <br /> <br />ANALYSIS <br /> <br />Section 1007.050 of the Zoning Ordinance establishes requirements for earth moving and land <br />reclamation. Earth removal, land reclamation, material storage or filling is a permitted use in all <br />zoning districts. An interim use permit is required when 5,000 cubic yards or more of material <br />is planned to be removed or deposited on any lot or parcel. <br /> <br />The approximately 40 acre site is located between 20th Ave and I-35E. The proposed stockpile <br />will be confined to a designated 40,000 SF area as shown in the proposed plans. The stockpile <br />will have a maximum height of 22 feet which is consistent with building heights of 35 feet in the <br />R zoning district. <br /> <br />Access <br /> <br />The site is currently accessed off 20th Ave via a shared private driveway. There are no proposed <br />improvements or impacts to 20th Ave. <br /> <br />Wetlands <br />
