C. The extent to which the environmental effects are subject to mitigation by <br />ongoing public regulatory authority. The RGU may rely only on mitigation <br />measures that are specific and that can be reasonably expected to effectively <br />mitigate the identified environmental impacts of the project; and <br />D. The extent to which environmental effects can be anticipated and controlled as a <br />result of other available environmental studies undertaken by public agencies or <br />the project proposer, including other EISs. <br />BACKGROUND <br />The thirty day comment period closed on January 16, 2025. The City received a number of <br />written comments from agencies and citizens. The City must respond to every substantive <br />comment. Substantive comments are comments that address the accuracy and completeness of <br />the materials contained in the EAW, potential impacts that may warrant further investigation <br />before the project is commenced, and the need for an Environmental Impact Statement (EIS) on <br />the proposed project. <br />The City's response to substantive comments received during the comment period are included <br />in the attached draft Record of Decision document. <br />Findings of Fact of the attached response document provides the City's findings of fact and <br />addresses each of the above referenced criteria. Section 6. Record of Decision concludes that an <br />EIS is not required. <br />The Environmental board reviewed the document at their January 29th meeting and had no <br />additional comments associated with the EAW. The board recommended Approving the <br />Record of Decision Making a Negative Declaration on the need for an Environmental Impact <br />Statement to Council. <br />RECOMMENDATION <br />Approve Record of Decision Making a Negative Declaration on the need for an Environmental <br />Impact Statement for the North Oaks Mixed Use Development. <br />ATTACHMENTS <br />• Response to comments, findings of fact, and record of decision <br />• Resolution NO. 25-12 <br />
