The amendment to Chapter 617, previously considered by the City Council, provides for <br />registration requirements for Cannabis Business including, number of retail licenses allowed, <br />buffer requirements from certain uses, and performance standards. <br />The amendment to Chapter 1007 relates to the City's role as the zoning authority. Cannabis <br />businesses are viewed as any other type of legal business, subject to the City's general zoning <br />regulations. A zoning ordinance text amendment has been drafted to include the various <br />license types into appropriate zoning districts. <br />ANALYSIS <br />For purposes of the Zoning requirements the primary focus will be on the appropriate districts <br />for each use. It is also necessary to determine whether the use is a permitted or conditional <br />use based on similar uses already established in the districts. <br />The licensed uses fall within the following categories: <br />Cultivation. Cannabis business licensed or endorsed for cultivation would be permitted as an <br />agricultural use and would be permitted indoor and outdoor in the R — Rural district. Indoor <br />cultivation would also be considered in Industrial districts. <br />Cannabis Manufacturer. Cannabis business licensed or endorsed for cannabis manufacturer <br />would be a permitted manufacturing use in the Light Industrial and General Industrial districts. <br />Consideration should be given to whether this would be a permitted or conditional use in the <br />Business Campus district. <br />Hemp Manufacturer. Cannabis business licensed or endorsed for low -potency hemp edible <br />manufacturers permitted as a manufacturing use in the industrial districts. <br />Wholesale. Cannabis business licensed or endorsed for wholesale would be permitted as a <br />wholesale sales use in the Light and General Industrial Districts and the Business Campus <br />districts. <br />Cannabis Retail. Cannabis business licensed or endorsed for cannabis retail are permitted as <br />retail sales in the Neighborhood Business, Limited Business, and General Business, Light <br />Industrial, General Industrial and Business Campus districts. <br />Cannabis Transportation and Cannabis Delivery. Cannabis business licensed or endorsed for <br />Transportation and Deliver would be permitted as warehousing uses in the Light and General <br />Industrial Districts and the Business Campus District. <br />The draft ordinance proposes the inclusion of cannabis uses as permitted where similar <br />activities are currently allowed. No conditional uses are proposed. Except for <br />microbusinesses, uses that included cultivation or retail sales were not allowed in the BC, <br />Business Campus district. <br />
