IV. FUTURE SUBDIVISION AND TRUNK UTILITY FEES No further subdivision of the property will be allowed until the City of Lino Lakes extends municipal utilities to service the property. At the time of subdivision all applicable City of Lino Lakes assessments and trunk utility fees will be due and payable. V. TERMINATION This Agreement may be terminated by the City of Shoreview if the City of Lino Lakes or the resident at 435 Ash Steet, Lino Lakes, MN violates the terms of the agreement or the provisions of Shoreview Code Chapters 500 and amendments thereto. The City of Lino Lakes may terminate this agreement upon disconnection of the utility service from City of Shoreview sanitary sewer, and 30-day prior written notice to the City of Shoreview of its intention to terminate. Disconnection of the service associated with termination shall be at the cost of the City of Lino Lakes and pursuant to plans approved by the City of Shoreview City Manager. Paragraph III Use Charges will continue to apply until City of Lino Lakes sends letter to City of Shoreview certifying disconnection of the service is complete. XI. INDEMNIFICATION To the extent allowed by law, the City of Shoreview and the City of Lino Lakes mutually agree to indemnify and hold harmless each other from any claims, losses, costs, expenses or damages resulting from the acts or omissions of the respective officers, agents, or employees relating to activities conducted by either party under this Agreement, except any claims, losses, costs, expenses or damages resulting from the other party's negligence or willful misconduct.
