Java Lino Lakes <br />Development Agreement <br />April 14, 2025 <br />requirements; If any building permits are issued prior to the completion and <br />acceptance of public improvements, the Developer assumes all liability and costs <br />resulting in delays in completion of public improvements and damage to public <br />improvements caused by the City, the Developer, its contractors, subcontractors, <br />material men, employees, agents or third parties. Any such costs shall be <br />reimbursed from Developer's escrow. <br />e. Developer acknowledges that no certificate of occupancy will be issued until the <br />Marketplace Drive improvements including public sanitary sewer and water <br />main, storm sewer, curb and gutter, bituminous base course, and temporary <br />street signs have been installed. The City shall make best efforts to complete <br />these improvements in a timely manner but shall assume no liability resulting <br />from delays in completion of improvements. <br />19. Special Provisions. <br />a. Shared Driveway and Parking Access Agreements and exhibits shall be recorded <br />detailing private maintenance responsibilities include the driveways, landscaped <br />parking lot medians, island landscaping, lighting, and other related <br />appurtenances. <br />i. Lot 1, Block 1, Java Lino Lakes to 7731 Lake Drive (American Legion) <br />ii. Lot 1 to Lot 2, Block 1, Java Lino Lakes <br />iii. Lot 1, Block 2, Java Lino Lakes to 7671 Lake Drive <br />b. The existing houses, driveways, and structures located within the plat shall be <br />removed and the ground properly restored within one (1) year of final plat <br />approval. <br />c. All private septic systems shall be properly removed. <br />d. All private wells shall be properly capped. <br />20. Hours of Construction Activity. <br />All construction activity shall be limited to the hours as follows: <br />Monday through Friday 7:00 a.m. to 7:00 p.m. <br />Saturday 9:00 a.m. to 5:00 p.m. <br />Sunday and Holidays No working hours allowed <br />21. Insurance. Developer or its general contractor shall take out and maintain until one <br />year after the City accepted the Developer Improvements, public liability and property <br />damage insurance covering personal injury, including death, and claims for property <br />page 11 <br />
