Java Lino Lakes <br />Development Agreement <br />April 14, 2025 <br />property owners. Lot corner irons on the back property line shall be installed so <br />that the top of the iron corresponds to the finished ground elevation in <br />accordance with the approved grading plan. Guard stakes shall be appropriately <br />installed to mark these irons. <br />i. Landscaping. Landscaping shall be furnished and installed in accordance with the <br />approved plans. The landscaping shall be maintained by the Developer until <br />accepted by the City's Environmental Coordinator. for Lot 2, Block 1. Developer <br />or assigns shall enter into a separate Site Performance Agreement for these <br />improvements on Lot 1, Block 1 and Lot 2, Block 2. <br />Developer shall be responsible for vegetative restoration of ponding areas, <br />outlots, and other native planting areas identified on the plans in accordance <br />with City Standard Specifications for Construction. Developer shall provide a <br />contract with a qualified firm for the establishment and maintenance of all open <br />space / native plant areas. Said contract shall cover a minimum of the 3 year <br />establishment period, from the date of planting. <br />Private Utilities. The Developer shall arrange for all gas, telecommunications, <br />cable, internet, electric, and other necessary private utility services to the <br />Subdivision in accordance with City Code and State law. The utilities are <br />required to be located within a joint trench. The Developer is solely responsible <br />for the cost of private utility and internet installation. <br />k. Mailboxes. This section intentionally left blank. <br />I. Wetland Buffer Signs. This section intentionally left blank. <br />7. Time of Performance. The Developer shall install all required improvements <br />enumerated in Paragraph 6 by October 30, 2026. The Developer may request a <br />reasonable extension of time from the City. If the extension is granted, it shall be <br />conditioned upon updating the security posted by the Developer to reflect cost <br />increases and the extended completion date. <br />8. City Improvements. Upon satisfaction of the requirements provided for in a certain <br />Purchase Agreement between the City and Java Companies, LLC, dated September 18, <br />2023, as amended, and dedication of public right-of-way and public easements as <br />shown in the Plat of Java Lino Lakes, the City will commence with the Marketplace Drive <br />Street and Utility improvements. <br />9. Record Drawings. <br />a. Upon project completion, Developer shall submit record drawings, in electronic <br />format, of all public and private infrastructure improvements constructed by the <br />page 4 <br />
