CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 6B <br />STAFF ORIGINATOR: Diane Hankee PE, City Engineer <br />MEETING DATE: April 28, 2025 <br />TOPIC: Ordinance No. 05-25, Vacating certain street, drainage, and <br />utility easements on 701" Street and Otter Crossing South <br />Consider 2"d Reading of Ordinance No. 05-25 <br />Consider Resolution No. 25-56, Approving Summary <br />Publication of Ordinance No. 05-25 <br />VOTE REQUIRED: 4/5 <br />INTRODUCTION <br />Staff is requesting City Council consideration of the 2"d Reading of Ordinance No. 05-25, <br />vacating certain street, drainage, and utility easements on 70t" Street and Otter Crossing <br />South. <br />BACKGROUND <br />The Otter Crossing South preliminary plat and commercial development is located on a 28 <br />acre site south of CSAH 14 (Main Street), east of 1-35E and west of CR 84 (Otter Lake Road). <br />The existing site includes three (3) lots which was a former bank that was recently removed. <br />The developer TYME Properties LLC, is proposing to preliminary plat one (1) commercial lot. <br />As a result of the newly proposed plat there are existing easements that will no longer be <br />valid. The new plat will grant of permanent easements to serve the development. <br />The existing easements include Document #1271202.0 an easement for public streets and <br />utility purposes and Document #487862.011 an easement for construction purposes shall be <br />vacated contingent upon filing of the Otter Crossing South final plat. The City will be <br />reimbursed in the amount of $23,325.00 for the City's original acquisition cost. <br />RECOMMENDATION <br />Staff is recommending approval of the 2"d Reading of Ordinance No. 05-25, vacating certain <br />street, drainage, and utility easements on 70t" Street and Otter Crossing South and Resolution <br />25-56 Approving Summary Publication of Ordinance 05-25. <br />
