CITY OF LINO LAKES, MINNESOTA <br />SITE IMPROVEMENT PERFORMANCE AGREEMENT <br />THIS SITE IMPROVEMENT PERFORMANCE AGREEMENT (this "Agreement") <br />made this day of , 2025 (the "Effective Date"), is by and <br />between the City of Lino Lakes, a municipal corporation organized under the laws of the <br />State of Minnesota (the "City"), and Aldi Inc. (Minnesota), a Minnesota corporation <br />("Developer"). <br />WHEREAS, Developer has received approval of certain Site Development Plans <br />dated (the "Plans") by the City on the day of , 2025, and in <br />accordance with the Plans all of which are made a part hereof by reference. In <br />consideration of such approval, Developer, its successors and assigns, does covenant <br />and agree to perform the work substantially (i.e., without material deviation) as set forth <br />in the Plans, in the aforesaid approval, and as hereinafter set forth upon the real estate <br />(hereinafter referred to as "Property") described as follows: <br />Tract A, Registered Land Survey No. 240, Anoka County, Minnesota. <br />And <br />That part of the Southwest Quarter of the Northeast Quarter of Section 24, Township <br />31, Range 22, described as follows: Beginning at the point of intersection of the South <br />line of County State Aid Highway 14 and the Easterly right-of-way line of Interstate <br />No. 35E; thence East along said South line of County State Aid Highway No. 14, a <br />distance of 200 feet; thence at a right angle South 250 feet; thence at a right angle <br />West 298.22 feet to the Easterly right of way line of Interstate Highway No. 35E; <br />thence Northerly along said Easterly right-of-way line 275.62 feet to the point of <br />beginning, according to the United States Government Survey thereof, Anoka County, <br />Minnesota. <br />NOW, THEREFORE, in consideration of the mutual promises of the parties made <br />herein, <br />IT IS AGREED BY AND BETWEEN THE PARTIES HERETO: <br />DESIGNATION OF IMPROVEMENTS. <br />A. Improvements on the Property set forth in the Plans to be installed at <br />Developer's expense by Developer as hereinafter provided are hereinafter <br />referred to as "On -Site Work". <br />B. Improvements off the Property set forth in the Plans to be installed at <br />Developer's expense, if any, by Developer as hereinafter provided are <br />hereinafter referred to as "Off -Site Work".
