2. Conforms to the applicable performance standards of this ordinance. <br /> <br />The proposed earth moving and stockpiling operation conform to the applicable <br />performance standards of this ordinance as detailed in this staff report. <br /> <br />3. The use is allowed as an interim use in the respective zoning district. <br /> <br />The property is zoned LI, Light Industrial. Earth moving and land reclamation is an <br />allowed interim use in this zoning district. <br /> <br />4. The date or event that will terminate the use can be identified with <br />certainty. <br /> <br />The proposed earth moving and stockpiling operations, including turf establishment, <br />shall be completed within 5 years of approval of the Interim Use Permit by City Council. <br /> <br />5. The use will not impose additional costs on the public if it is necessary <br />for the public to take the property in the future. <br /> <br />The proposed earth moving and stockpiling operation will not impose additional costs on <br />the public. <br /> <br />6. The user agrees to any conditions that the City Council deem <br />appropriate for the permission of the use. <br /> <br />The user agrees to the conditions detailed in the Council resolution. <br /> <br />Per City Code Section 1007.016(3) Conditional Use Permits: <br /> <br /> (e) The Planning and Zoning Board shall hold the public hearing and consider <br />possible adverse effects of the proposed conditional use. Its judgement shall be based <br />upon, but not limited to, the following factors: <br /> <br />1. The proposed development application has been found to be <br />consistent with the design standards listed in City Code Section <br />1007.020(4). <br /> <br />The proposed earth moving and stockpiling operation is consistent with the design <br />standards as noted below. <br /> <br />2. Will not involve uses, activities, processes, materials, equipment and <br />conditions of operation that will be detrimental to any persons, <br />property, or the general welfare because of excessive production of <br />traffic, noise, smoke, fumes, glare, or odors. <br />4 <br /> <br />
