(b) For plats that consist solely of individual single family residential lots, final plat <br />applications for subsequent phases shall not be approved until building permits have <br />been issued for 40% of lots in the preceding phase. This division applies only when the <br />preceding phase consists of 40 or more lots. <br />Not applicable. This is a one (1) lot commercial subdivision. <br />(c) City attorney approval of the status of title/property ownership related to the final plat. <br />The City attorney reviewed the status of the title/property ownership related to the final <br />plat. <br />(d) Completed development contract. <br />A Development Agreement has been completed and shall be executed. <br />(e) Conditions attached to approval of the preliminary plat shall be fulfilled or secured by <br />the development agreement, as appropriate; and <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with a Development Agreement. <br />(f) All fees, charges and escrow related to the preliminary or final plat shall be paid in full. <br />All fees, charges and escrow related to the preliminary or final plat shall be paid in full prior <br />to release of the final plat mylars. <br />BE IT FURTHER RESOLVED the final plat is approved subject to the following conditions: <br />1. A declaration stating Lot 1 and Lot 1A, Otter Crossing South shall be maintained together <br />for the purposes of sale and development shall be recorded. <br />2. A shared access, parking, and maintenance agreement and exhibit shall be recorded. <br />3. A declaration of access control along CR 84 (Otter Lake Road) and exhibit shall be <br />recorded. <br />BE IT FURTHER RESOLVED the following items shall be addressed prior to release of the <br />final plat mylars: <br />1. All comments from the City Engineer memos dated May 7, 2025. <br />2. The City Attorney shall draft the quit claim deed related to the vacations. <br />3. A conveyance from VoranDeSoto LLC to CLINO is required. <br />
