CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 7B <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br />MEETING DATE: June 23, 2025 <br />TOPIC: Vacating Drainage and Utility Easement on Outlot A, Alino <br />Addition, Diane Hankee <br />Consider 2nd Reading of Ordinance No. 11-25 <br />Consider Resolution No. 25-88, Approving Summary <br />Publication of Ordinance No. 11-25 <br />VOTE REQUIRED: Super Majority <br />INTRODUCTION <br />City Council is consideration the 2nd Reading of Ordinance No. 11-25 vacating drainage and <br />utility easement on Outlot A, Alino Addition. <br />BACKGROUND <br />The Clearwater Commons preliminary plat and commercial development is located on a 2.28- <br />acre site north of CSAH 14 (Main Street), east 215t Avenue North and west I-35E. The existing <br />site consists of Outlot A. The developer, Capital Real Estate, Inc, is proposing to preliminary <br />plat three (3) commercial lots on a part of Outlot A. As a result of the newly proposed plat, <br />there is an existing easement that is proposed to be modified to accommodate the new <br />development. The new plat will grant permanent easements to serve the development. <br />The existing easement, Document #2084186.005, is an easement for drainage and utility <br />purposes, and a portion of the easement shall be vacated contingent upon filing of the <br />Clearwater Commons final plat. <br />The City held a public hearing on June 9, 2025 for the drainage and utility easement vacate <br />where there were no comments received. <br />RECOMMENDATION <br />Staff is recommending approval of the 2nd Reading of Ordinance No. 11-25 Vacating drainage <br />and utility easement on Outlot A, Alino Addition and Resolution 25-88 Approving Summary <br />Publication of Ordinance 11-25. <br />Page 125 of 142 <br />
