The incidental take of migratory <br /> birds is the injury or death of birds that results from, but is not the purpose, of an activity. The <br /> Service interprets the MBTA to prohibit incidental take. <br /> 1. The Migratory Birds Treaty Act of 1918. <br /> 2. The Bald and Golden Eagle Protection Act of 1940. <br /> 3. 50 C.F.R.
