The incidental take of migratory <br />birds is the injury or death of birds that results from, but is not the purpose, of an activity. The <br />Service interprets the MBTA to prohibit incidental take. <br />1. The Migratory Birds Treaty Act of 1918. <br />2. The Bald and Golden Eagle Protection Act of 1940. <br />3. 50 C.F.R. Sec. 10.12 and 16 U.S.C.
