the proposed project is not anticipated to have an adverse impact on the whooping <br />crane. <br />• Western Regal Fritillary: The proposed project may affect the western regal fritillary <br />and/or suitable fritillary habitat, but disturbances are anticipated to be temporary in <br />nature and/or insignificant given available foraging and breeding habitat in the <br />surrounding landscape; therefore, long-term impacts to western regal fritillary are not <br />anticipated. Additionally, the use of native species in seed mixes may be used to <br />promote pollinator friendly habitat within the study area. Current climate trends may <br />impact the availability of suitable habitat in the study area. <br />• Salamander Mussel: The proposed project is not anticipated to affect the <br />salamander mussel as a result of the lack suitable mussel habitat identified within the <br />study area or directly adjacent to the study area. <br />State -Listed Species <br />The MnDNR Natural Heritage Review (NHR) letter identified the following state -listed species <br />may be affected by the proposed project scenarios. Many state -listed plant species were <br />identified as having the potential to be affected by the proposed development scenarios: <br />• A Bristle Berry (Rubus stipulates) - State -listed endangered species <br />• Autumn Fimbry (Fimbristylis autumnalis) - State -listed threatened species <br />• Black Huckleberry (Gaylussacia baccata) — State -listed threatened species <br />• Blunt -lobed Grapefern (Sceptridium oneidense) — State -listed threatened species <br />• Clinton's Bulrush (Trichophorum clintonii) — State -listed threatened species <br />• Cross -leaved Milkwort (Polygala cruciata) — State -listed endangered species <br />• Fuller's Bristle -berry (Rubus fulleri) — State -listed threatened species <br />• Lance -leaved Violet (Viola /anceo/ata) — State -listed threatened species <br />• Pale Sedge (Carex pallescens) — State -listed endangered species <br />• Slimspike Three -awn (Aristida longespica var. geniculata) — State -listed <br />endangered species <br />• St. Lawrence Grapefern (Sceptridium rugulosum) - State -listed threatened <br />species <br />• Swamp Blackberry (Rubus semisetosus) — State -listed threatened species <br />• Toothcup (Rota/a ramosior) — State -listed threatened species <br />• Tubercled Rein Orchid (Platanthera flava var. herbiola) — State -listed threatened <br />species <br />• Twisted Yellow -eyed Grass (Xyris torta) — State -listed endangered species <br />Blanding's turtle (Emydoidea blandingii) is a state -listed threatened species has been <br />documented in the vicinity of the study area. <br />Bald and Golden Eagles <br />Bald eagles (Haliaeetus leucocephalus) and golden eagles (Aquila chrysaetos) have federal - <br />level protections under the Bald and Golden Eagle Treaty Act (BGEPA) (16 U.S.C. 668-668d). <br />Originally enacted in 1940, and since amended, BGEPA prohibits anyone without a permit <br />issued by the Secretary of the Interior from take of bald or golden eagles, including their parts, <br />nests, or eggs.
