Iron monuments shall be placed after all street and lawn <br />grading has been completed in order to preserve the lot markers for future <br />property owners. Lot corner irons on the back property line shall be installed so <br />that the top of the iron corresponds to the finished ground elevation in <br />accordance with the approved grading plan. Guard stakes shall be appropriately <br />installed to mark these irons. <br />i. Landscaping. Landscaping shall be furnished and installed in accordance with the <br />approved plans. The landscaping shall be maintained by the Developer until <br />accepted by the City’s Environmental Coordinator. for Lot 2 and Lot 3, Block 1. <br />Developer or assigns shall enter into a separate Site Performance Agreement for <br />these improvements on Lot 1, Block 1. <br />Developer shall be responsible for vegetative restoration of ponding areas, <br />outlots, and other native planting areas identified on the plans in accordance <br />with City Standard Specifications for Construction. Developer shall provide a <br />contract with a qualified firm for the establishment and maintenance of all open <br />space / native plant areas. Said contract shall cover a minimum of the 3 year <br />establishment period, from the date of planting. <br />j. Private Utilities. The Developer shall arrange for all gas, telecommunications, <br />cable, internet, electric, and other necessary private utility services to the <br />Subdivision in accordance with City Code and State law. The utilities are <br />required to be located within a joint trench. The Developer is solely responsible <br />for the cost of private utility and internet installation. <br />k. Mailboxes. This section intentionally left blank. <br />l. Wetland Buffer Signs. This section intentionally left blank. <br />7. Time of Performance. The Developer shall install all required improvements <br />enumerated in Paragraph 6 by October 30, 2026. The Developer may request a <br />reasonable extension of time from the City. If the extension is granted, it shall be <br />conditioned upon updating the security posted by the Developer to reflect cost <br />increases and the extended completion date. <br />8. City Improvements. The City shall remove the existing 8” water main in the vacated <br />77th Street right of way and install water and sanitary sewer services for Lots 2 and 3, <br />Java Second Addition. The developer shall reimburse the City for said costs incurred for <br />said improvements as shown in Exhibit B. <br />9. Record Drawings. <br />Page 135 of 171
