The final plat substantially conforms with the preliminary plat and phasing plan. <br />(b)For plats that consist solely of individual single family residential lots, final plat <br />applications for subsequent phases shall not be approved until building permits have <br />been issued for 40% of lots in the preceding phase. This division applies only when the <br />preceding phase consists of 40 or more lots; and <br />NA. The development is proposed to be constructed in one (1) phase. <br />(c)Conditions attached to approval of the preliminary plat shall be substantially fulfilled or <br />secured by the development agreement, as appropriate. <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with a Development Agreement. <br />RECOMMENDATION <br />Staff recommends approval of the Hampton Addition final plat with the following conditions: <br />1.The developer shall deed Outlot A to the City. <br />2.The developer shall record a temporary easement with exhibit for the cul de sac. <br />3.The developer shall submit to the City the MPCA SSTA Abandonment Reporting Form as <br />proof that the private septic system has been properly removed. <br />4.The developer shall submit to the City the MDH Well and Boring Sealing Record as proof <br />that the private well has been properly capped. <br />5.The housing units on the west side of Osakis Street shall meet the following noise <br />mitigation requirements: <br />a.The buildings are constructed in such a way that the exterior to interior sound <br />level attenuation is at least 30 dB(A). <br />b.The buildings have year-round climate control. <br />th <br />6.The developer shall construct the trail along CSAH 54 (20 Avenue). <br />The following items shall be addressed prior to the issuing a grading permit and/or building <br />permits: <br />1.All comments from the City Engineer memo dated September 3, 2025. <br />2.All comments from the Environmental Coordinator memo dated September 3, 2025. <br />3.Recorded copies of the following documents shall be provided to the City: <br />a.Final plat <br />b.Development Agreement <br />c.Declaration of Maintenance for Stormwater Facilities <br />d.Stormwater Re-use Agreement <br />e.Temporary Cul de Sac Easement <br />f.Deed <br />4 <br /> <br />
