3 <br /> <br />(c) Conditions attached to approval of the preliminary plat shall be substantially fulfilled or <br />secured by the development agreement, as appropriate. <br /> <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with a Development Agreement. <br /> <br />Public Land Dedication <br /> <br />The City will collect cash fee in lieu of land dedication based on the acreage of the three (3) <br />commercial platted lots. <br /> <br />Clearwater Commons <br />2.28 acres x $2,600 per acre = $5,928 <br /> <br />Title Commitment <br /> <br />The City Attorney reviewed the title commitment and notes that the plat and development <br />agreement shall be recorded before any mortgage interests. <br /> <br />Agreements <br /> <br />Stormwater Maintenance Agreement <br /> <br />The stormwater facilities will be privately maintained, and a Declaration for Maintenance of <br />Stormwater Facilities will be required. Both the Rice Creek Watershed District (RCWD) and the <br />City of Lino Lakes shall be parties to the Declaration <br /> <br />Development Agreement and Final Plat <br /> <br />A Development Agreement has been prepared by the City and shall be executed. <br /> <br />Site Improvement Performance Agreement <br /> <br />Site Improvement Performance Agreements will be required for the construction of each <br />commercial building. <br /> <br />Planning & Zoning Board <br /> <br />The Planning & Zoning Board reviewed the final plat on August 13, 2025. Per City Code Section <br />1001.057 Review, Approval or Denial: <br /> <br /> (1) The Planning and Zoning Board shall consider the final plat and the Community <br />Development Department shall forward the Planning and Zoning Board recommendations to <br />Page 124 of 168
