CITY OF LINO LAKES <br />RESOLUTION NO. 25-133 <br />RESOLUTION DECLARING COSTS TO BE ASSESSED AND CALLING HEARING ON PROPOSED <br />ASSESSMENT <br />2025 DELINQUENT UTILITY CHARGES <br />WHEREAS, pursuant to City Code Sections 401.3, 402.14 & 404.10, any delinquent utility <br />accounts may be presented for as an assessment against the property. <br />WHEREAS, the City has incurred delinquent utility balances in 2025. <br />WHEREAS, the total cost delinquent utility balances due to the City are $192,504.13. <br />WHEREAS, the Finance Director notifies the City Council that such proposed assessments will be <br />completed and filed with the City Clerk's office for public inspection. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes, Minnesota that: <br />1. The portion of the cost of such services to be assessed against benefited property owners is <br />declared to be 192,504.13. <br />2. Assessments shall be payable in equal annual installments extending over a period of one year, <br />the first of the installments to be payable on or before the first Monday in January 2026 and shall <br />bear interest at the rate of 5% percent per annum from the date of the adoption of the assessment <br />resolution. <br />3. The Finance Director shall submit a list of the costs for services the City has incurred for past <br />due utility accounts, as provided by law, and shall file a copy of such proposed assessment in the <br />office of the City Clerk for public inspection, as provided by law, and he/she shall file a copy of such <br />proposed assessment in her office for public inspection. <br />4. The clerk shall upon the completion of such proposed assessment, notify the council thereof. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes, Minnesota that: <br />1. A hearing shall be held at 6:30 p.m. on October 13, 2025, in the city hall located at 600 Town <br />Center Parkway to pass upon such proposed assessment. All persons owning property affected by <br />will be given an opportunity to be heard with reference to such assessment. <br />2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment <br />to be published once in the official newspaper at least two weeks prior to the hearing, and she shall <br />state in the notice the total cost of the improvement.
