CITY OF LINO LAKES RESOLUTION NO. 25-133 RESOLUTION DECLARING COSTS TO BE ASSESSED AND CALLING HEARING ON PROPOSED ASSESSMENT 2025 DELINQUENT UTILITY CHARGES WHEREAS, pursuant to City Code Sections 401.3, 402.14 & 404.10, any delinquent utility accounts may be presented for as an assessment against the property. WHEREAS, the City has incurred delinquent utility balances in 2025. WHEREAS, the total cost delinquent utility balances due to the City are $192,504.13. WHEREAS, the Finance Director notifies the City Council that such proposed assessments will be completed and filed with the City Clerk's office for public inspection. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes, Minnesota that: 1. The portion of the cost of such services to be assessed against benefited property owners is declared to be 192,504.13. 2. Assessments shall be payable in equal annual installments extending over a period of one year, the first of the installments to be payable on or before the first Monday in January 2026 and shall bear interest at the rate of 5% percent per annum from the date of the adoption of the assessment resolution. 3. The Finance Director shall submit a list of the costs for services the City has incurred for past due utility accounts, as provided by law, and shall file a copy of such proposed assessment in the office of the City Clerk for public inspection, as provided by law, and he/she shall file a copy of such proposed assessment in her office for public inspection. 4. The clerk shall upon the completion of such proposed assessment, notify the council thereof. BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes, Minnesota that: 1. A hearing shall be held at 6:30 p.m. on October 13, 2025, in the city hall located at 600 Town Center Parkway to pass upon such proposed assessment. All persons owning property affected by will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the improvement.
