Page 8 <br /> <br />• People who have permission from the subject of the data; <br />• The Internal Revenue Service and Minnesota Department of Revenue; <br />• The Immigration and Naturalization Service; <br />• The Minnesota Department of Economic Security in any claim for reemployment <br />benefits; <br />• The Worker’s Compensation Court in any claim for worker’s compensation benefits; <br />• Various insurance companies in any claim for insurance benefits; <br />• Individuals who have obtained a court order for the information; <br />• Participant in any litigation, mediation, veteran’s preference hearing, grievance <br />arbitration, or other administrative proceeding that involves the employee; <br />• Labor organizations and the Bureau of Mediation Services. <br />D. Private Data <br />The following personnel data are considered private data on individuals and are not accessible <br />to the public: social security number, age, sex, marital and family status, employee’s home <br />address and telephone number, criminal record, race and ethic data, insurance status, <br />references, college transcripts (except for name of institution, degrees, and years attended), <br />reference checks, medical records, psychological examinations, workers’ compensation reports, <br />physical limitations related to job, sick leave forms, medical reports, data collected from <br />disciplinary proceedings, opinion questionnaires, names of applicants for employment until <br />finalists are announced, employee assistance programs and exit interview responses. Private <br />data is accessible to the subject employee, the employee's authorized representative, the <br />immediate supervisor and department director, and other City staff persons or officials who <br />have a legitimate need to know such data. <br />No employee may disclose the home address, telephone number, or personal information <br />about another employee to any third party without prior consent of the affected employee, as <br />per the section on "Informed Consent." <br />Employment selection instruments and answer keys to such instruments are protected non- <br />public data, except pursuant to a valid court order. <br />E. Access to Data <br />• Public Data. Access shall be provided to any person, without regard to the nature of the <br />person's interest. Access must be provided by Administration or other persons authorized <br />by the City Administrator. Access must be provided within a reasonable time period. <br />Interpretation shall be provided if requested. A fee may be charged for copying and <br />mailing and for the time it takes to collect the information. <br />• Private Data. Access to private data is available only to: (1) the subject of the data; (2) <br />City employees who need access to the data; (3) agencies authorized by state or federal <br />law who need access to specific data; and (4) agencies or individuals with written <br />consent from the subject of the data. <br />Page 139 of 228
