CITY COUNCIL <br />STAFF REPORT <br />AGENDA ITEM 1.J. <br /> <br />STAFF ORIGINATOR: Tracy Thoma, Finance Director <br /> <br />MEETING DATE September 22, 2025 <br /> <br />AGENDA ITEM: Approval of Resolution No. 25-133, Declaring Costs to be Assessed and <br />Calling for Public Hearing on Proposed Assessments - 2025 Delinquent <br />Utility Charges <br /> <br />VOTE REQUIRED: Simple Majority <br /> <br /> <br />INTRODUCTION <br />Staff have prepared a resolution requesting the Council declare delinquent utility accounts to <br />be assessed and to call for a public hearing on the proposed assessment thereof. <br /> <br />BACKGROUND <br />The purpose of this agenda item is for the City Council to set an assessment hearing date for <br />2025 Delinquent Utility Accounts. The assessment roll that will be prepared for the public <br />hearing will include the unpaid balances by PID number and property street address <br />information. <br /> <br />State Statutes 429.101 and 444.075 and Sections 401.3, 402.14 & 404.10 of the Lino Lakes City <br />Code state that a city may certify unpaid special charges, including unpaid utility bills, to the <br />County Auditor as a special assessment against the property. <br /> <br />To recover unpaid past due utility accounts, the City must follow State Statute 429.101 <br />procedures. These procedures require that the City must adopt a resolution declaring the past <br />due accounts to be assessed and establish a date for the assessment hearing for those <br />charges. <br /> <br />The assessment shall include the annual principal (unpaid charges and penalty balance due), an <br />administration filing fee of $30.00, and shall bear interest at the rate of 5.00% per annum. In <br />relation to the delinquent accounts being considered as part of this resolution, property <br />owners have been provided the opportunity to pay the charges prior to the assessment <br />certification. <br /> <br /> <br />Staff is proposing a public hearing date be set for October 13, 2025.
