applications for subsequent phases shall not be approved until building permits have <br />been issued for 40% of lots in the preceding phase. This division applies only when the <br />preceding phase consists of 40 or more lots. <br />Not applicable. This is a 14 lot residential subdivision that will be completed in one <br />phase. <br />(c) City attorney approval of the status of title/property ownership related to the final plat. <br />The City Attorney reviewed the title commitment and final plat and had no concerns. <br />(d) Completed development contract. <br />A Development Agreement has been completed and shall be executed. <br />(e) Conditions attached to approval of the preliminary plat shall be fulfilled or secured by <br />the development agreement, as appropriate; and <br />The conditions of the preliminary plat have been substantially fulfilled. Securities will be <br />required with the Development Agreement. <br />(f) All fees, charges and escrow related to the preliminary or final plat shall be paid in full. <br />All fees, charges and escrow related to the preliminary or final plat shall be paid in full prior <br />to release of the final plat mylars. <br />BE IT FURTHER RESOLVED the final plat is approved subject to the following conditions: <br />1. The developer shall submit to the City the MPCA SSTA Abandonment Reporting Form as <br />proof that the private septic system has been properly removed. <br />4. The developer shall submit to the City the MDH Well and Boring Sealing Record as proof <br />that the private well has been properly capped. <br />5. The housing units on the west side of Osakis Street shall meet the following noise <br />mitigation requirements: <br />a. The buildings are constructed in such a way that the exterior to interior sound <br />level attenuation is at least 30 dB(A). <br />b. The buildings have year-round climate control. <br />6. The developer shall construct the trail along CSAH 54 (201h Avenue). <br />BE IT FURTHER RESOLVED the following items shall be addressed prior to the issuing a grading <br />
