1 <br /> <br />CITY COUNCIL <br />REGULAR MEETING STAFF REPORT <br />AGENDA ITEM 1.G. <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> <br />MEETING DATE: October 13, 2025 <br /> <br />TOPIC: Approval of Resolution No. 25-140 Extending Construction Start <br />Date for Automobile Repair-Minor on Lot 1, Block 2, Java Lino <br />Lakes <br /> <br />VOTE REQUIRED: Simple Majority <br />______________________________________________________________________________ <br /> <br />INTRODUCTION <br /> <br />The developer, Java Companies, is requesting an extension to start construction on the <br />automobile repair-minor project proposed on Lot 1, Block 2, Java Lino Lakes. The proposed end <br />user is Valvoline and the property address is 7685 Lake Drive. <br /> <br />BACKGROUND <br /> <br />On November 12, 2024, the City Council passed Resolution No. 24-143 approving the <br />conditional use permit for automobile repair-minor. Per City Code Section 1007.016 regarding <br />conditional use permits: <br /> <br /> (4) Expiration. The applicant shall commence the use or construction within one year of the <br />date of approval unless a different time is specified in the conditional use permit. Otherwise, <br />the approval shall be null and void, unless an extension is requested in writing, and for good <br />cause, is granted by the City Council. A conditional use specified in the permit expires if, for any <br />reason, the authorized use ceases for more than one year. <br /> <br />The construction start date deadline is November 12, 2025. The developer has requested an <br />extension while Java Lino Lakes 2nd Addition is finalized and Marketplace Drive construction is <br />complete. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends approval of Resolution No. 25-140 extending the construction start date one <br />(1) year to November 12, 2026. <br /> <br /> <br />Page 27 of 145
