LIQUOR VIOLATIONS HEARING <br />STAFF ORIGINATOR: Chief John Swenson <br />HEARING DATE: November 25, 2013 <br />TOPIC: Liquor License Violation — Tavern on Main <br />Liquor License Hearing — Background / Recommendation <br />On August 28, 2013, members of the police department employed two underage <br />buyers to conduct alcohol compliance checks at licensed on and off sale liquor <br />establishments in City of Lino Lakes. The buyers were ages 18 and 19. <br />The buyers entered Tavern on Main at approximately 8:47 PM and took a seat at the <br />bar. The bartender, Ms. Radden, took the order for two alcoholic beverages from the <br />buyers and did not ask for identification or ask them what their ages were. Ms. <br />Radden served the buyers with the alcoholic beverages and took payment for the <br />beverages. <br />Members of the police department identified Ms. Radden and issued her a citation for <br />Furnishing Alcohol to a Minor. Ms. Radden pled guilty to this offense on October 23, <br />2013 in Anoka County District Court. <br />Per Minnesota statue 340A.50 — Responsibility of Licensee <br />Every licensee is responsible for the conduct in the licensed establishment and <br />any sale of alcoholic beverage by any employee authorized to sell alcoholic beverages <br />in the establishment is the act of the licensee for the purposes of all provisions of this <br />chapter except sections 340A.701, 340A.702, and 340A.703. <br />This is the first license violation at Tavern on Main in a 12 month period. <br />RECOMMENDATION <br />In accordance with the Best Practices Grid, a $500 civil penalty is recommended. <br />ATTACHMENT <br />Best Practices Grid <br />Section 701.01 of the City Code <br />Minnesota State Statute 340A.501 & 340A.503 <br />
